الملخص

هدفت  الدراسة إلى بيان مدى قدرة المنظومة الإجرائية الحالية في القانون الاتحادي بشأن حماية البيئة وتنمينها في ضـمان التحقيق الجنائي في جرائم البيئة البحرية ، وتعزيز الأدلة القائمة على نسـبة الجريمة إلى المتهم ، والوقوف على مدى كفاية القواعد الإجرائية العامة في ضـمان فعالية التحقيق في جرائم البيئة البحرية وإقامة المسؤولية الجزائية بحق المتهمين ، واعتمدت الدراسة على المنهج الوصـفي من خلال التعرف على جريمة البيئة البحرية محل الحماية الإجرائية وخصائصها ، وبيان مهام وواجبات وسلطات مأموري الضبط القضائي في تلك الجرائم ، كما اعتمدت الدراسة على المنهج التحليلي المقارن من خلال تحليل النصـوص القانونية التي تعالج الموضـوع في كل من المرسوم بقانون اتحادي رقم ( ۳۸ ) لسـنة ٢٠٢٢ بشـأن قانون الإجراءات الجزائية ، والقانون الاتحادي رقم ( ٢٤ ) لسنة ١٩٩٩ بشـأن حماية البيئة وتنميتها ولائحته التنفيذية ، مقارنة بقانون حماية البيئة المصري رقم ( 9 ) لسنة ٢٠٠٩ وتعديلاته ، بالإضـافة إلى الأحكام القضـائية ، وتوصلت الدراسـة إلى عدة نتائج أهمها أن كل من القانون الإماراتي والمصري لم يحددا على سبيل الحصر. أو بشكل قاطع مهام مأموري الضبط القضائي ، لاسيما بشأن إجراء التحريات وجمع المعلومات للكشـف عن جرائم ومخالفات البيئة البحرية ، حيث أنها أوردت مهام عامة ، واكتفت بذلك لتترك لهم المجال واسـعاً في اتخاذ ما يرونه مناسباً من إجراءات يستطيعون من خلالها ضبط إثبات جرائم ومخالفات البيئة البحرية ، مع الأخذ في الاعتبار أن تكون في حدود مبدأ المشروعية ولا تخرج عن إطاره ، وأوصت الدراسة بضرورة إنشاء محاكم متخصصة وجهات تحقيق متخصصة للنظر في جرائم البيئة البحرية ، وذلك بهدف سرعة الفصـل فيها ، وعلى أن يكون ضـمن تشكيلها أحد الخبراء المتخصصين في مجال البيئة البحرية

Abstract

The  study aimed to demonstrate the extent of the ability of the current procedural system in the federal law regarding environmental protection and development to ensure the criminal investigation of marine environment crimes, strengthen the evidence based on the attribution of the crime to the accused, and determine the adequacy of the general procedural rules in ensuring the effectiveness of the investigation of marine environment crimes and establishing Criminal liability against the accused. The study relied on the descriptive approach by identifying the marine environment crime subject to procedural protection and its characteristics, and explaining the tasks, duties and powers of judicial officers in those crimes. The study also relied on the comparative analytical approach through analyzing the legal texts that address the subject in each case. From Federal Decree Law No. ( 38 ) of 2022 regarding the Code of Criminal Procedure, and Federal Law No. ( 24 ) of 1999 regarding environmental protection and development and its executive regulations, compared to the Egyptian Environmental Protection Law No. ( 9 ) of 2009 and its amendments, in addition to judicial rulings, and the study concluded To several results, the most important of which is that both the Emirati and Egyptian law did not exclusively or categorically define the tasks of judicial police officers, especially regarding conducting investigations and gathering information to uncover crimes and violations of the marine environment, as they listed general tasks, and limited themselves to that, leaving them wide scope to take action. What procedures they deem appropriate through which they can control the proof of crimes and violations of the marine environment, taking into account that they are within the limits of the principle of legality and do not deviate from its framework. The study recommended the necessity of establishing specialized courts and specialized investigation bodies to look into crimes in the marine environment, with the aim of quickly adjudicating them. It must be composed of an expert specialized in the field of marine environment.
