<p style="direction: rtl;">تناول البحث الوساطة الجزائية كبديل مستحدث لإنهاء الدعوى الجزائية في قانون الإجراءات الجزائية الاتحادي. دراسة مقارنة من خلال التعرف على مفهوم بدائل الدعوى الجزائية وتطورها التاريخي و التعرف على أسباب ظهور بدائل الدعوى الجزائية المعاصرة من خلال فشل السياسة الإجرائية في مكافحة الجريمة و أسباب اجتماعية أدت لظهور بدائل الدعوى الجزائية والاحكام الموضوعية لنظام الوساطة الجزائية من خلال التعرف ماهية الوساطة الجزائية و تمييز بين نظام الوساطة الجزائية والأنظمة المشابهة لها والتعرف الطبيعة القانونية لنظام الوساطة الجزائية وصورها ثم تطرق البحث شروط ونطاق تطبيق الوساطة الجزائية للتعرف على الشروط الشكلية للوساطة القانونية و الشروط الموضوعية للوساطة القانونية ثم التطرق الى نطاق تطبيق الوساطة القانونية من حيث الأطراف ومن حيث الجرائم ثم تناول البحث الأحكام الإجرائية لنظام الوساطة الجزائية وآثارها من خلال إجراءات نظام الوساطة الجزائية في مرحلة التمهيد للوساطة الجزائية و مرحلة التحضير للوساطة الجزائية ومرحلة الاتصال بطرفي النزاع و مرحلة جلسات الوساطة الجزائية وتنفيذها و مرحلة الاتفاق والتفاوض في الوساطة الجزائية ومرحلة تنفيذ الوساطة الجزائية واخيرا آثار نظام الوساطة الجزائية على الدعوى الجزائية وذلك من اجل الوصول الى أثر نجاح الوساطة الجزائية من خلال حفظ الدعوى الجزائية و انقضاء الدعوى الجزائية و أثر فشل الوساطة الجزائية بالنسبة للدعوى الجزائية. وعلى الدعوى المدنية.</p>

<p style="direction: ltr; text-align: left;">The research dealt with criminal mediation as a new alternative to ending the criminal case in the Federal Criminal Procedure Law ( comparative study ) by identifying the concept of alternatives to the criminal case and its historical development and identifying the reasons for the emergence of alternatives to the contemporary criminal case through the failure of the procedural policy in combating crime and social reasons that led to the emergence of alternatives to the criminal case and the substantive provisions of the criminal mediation system by identifying the nature of criminal mediation and distinguishing between the criminal mediation system and similar systems and identifying the legal nature of the criminal mediation system and its forms. Then the research addressed the conditions and scope of application of criminal mediation to identify the formal conditions of legal mediation and the substantive conditions of legal mediation, then addressing the scope of application of legal mediation in terms of parties and in terms of crimes. Then the research addressed the procedural provisions of the criminal mediation system and its effects through the procedures of the criminal mediation system in the preparatory stage for criminal mediation and the stage of preparation for criminal mediation and the stage of contacting the two parties to the dispute and the stage of criminal mediation sessions and their implementation and the stage of agreement Negotiation in criminal mediation, the stage of implementing criminal mediation, and finally the effects of the criminal mediation system on the criminal case, in order to reach the effect of the success of criminal mediation through preserving the criminal case and the expiration of the criminal case and the effect of the failure of criminal mediation with respect to the criminal case and the civil case.</p>
