Abstract
<p style="direction: rtl;"><strong>الملخص</strong></p>
<p style="direction: rtl;">تناولت هذه الدراسة موضوع أثر الأوضاع الوظيفية في تحديد المركز القانوني للموظف العام في دولة الإمارات العربية المتحدة على المستوى الإتحادي والمستوى المحلي لإمارة عجمان ، وبيان ماهية الأوضاع الوظيفية ، إضافة إلى تحديد أنواع الأوضاع الوظيفية التي نظمها قانون الموارد البشرية الاتحادي في دولة الإمارات وقانون الموارد البشرية في إمارة عجمان ، وكذلك تحليل النظام القانوني للأوضاع الوظيفية المختلفة التي نص عليها المشرع الإماراتي ، مع بيان الأثر القانوني للأوضاع الوظيفية في تحديد المركز القانوني للموظف العام سواء سلباً أو إيجاباً من خلال المقارنة بين موقف المشرع الإماراتي في المرسوم بقانون اتحادي رقم ( 49 ) لسنة 2022 بشأن الموارد البشرية في الحكومة الاتحادية ولائحته التنفيذية ، والمرسوم الأميري رقم ( 4 ) لسنة 2017 بشأن الموارد البشرية في حكومة عجمان ولائحته التنفيذية وتعديلاتهما ، والضوابط المتعلقة بالأوضاع الوظيفية وبيان إجراءات الرقابة الادارية والقضائية على القرارات الإدارية المتعلقة بالأوضاع الوظيفية ومدى حمايتها لحقوق الموظف العام. وتعتبر هذه الدراسة من الدراسات الهامة للموظفين في الدولة وفي إمارة عجمان، كونها تعتبر قاعدة علمية يمكن الاعتماد عليها كمدخل لتعديل أنظمة الموارد البشرية.</p>
<p style="direction: rtl;">اعتمدت هذه الدراسة على المنهجين الوصفي والتحليلي بالإضافة إلى المنهج المقارن ، أما المنهج الوصفي فيقوم على وصف الموضوع من الناحية النظرية من حيث المفاهيم والتعريفات والضوابط ، والمنهج التحليلي يقوم على تحليل الآراء الفقهية والأحكام القضائية والنصوص القانونية في قانون الموارد البشرية الاتحادي وقانون الموارد البشرية في إمارة عجمان من حيث التنظيم القانوني للأوضاع الوظيفية وتأثيرها على المركز القانوني للموظف العام ، أما المنهج المقارن فيقوم على المقارنة بين موقف المشرع الإماراتي على المستوى الاتحادي والمستوى المحلي لإمارة عجمان.</p>
<p style="direction: rtl;">ومن أبرز نتائج هذه الدراسة تبين بأن هناك توافق بين قانون الموارد البشرية في الحكومة الاتحادية وقانون الموارد البشرية في إمارة عجمان من حيث الطبيعة القانونية للترقية والندب وتعديل الوضع الوظيفي والإعارة، ولكن هناك بعض الاختلافات الجوهرية بينهما فيما يخص التنظيم القانوني والضوابط المتعلقة بالنقل والإعارة وتعديل الوضع الوظيفي. كما أنه من خلال دراسة الرقابة على القرارات المتعلقة بالأوضاع الوظيفية تبين بأن للإدارة ممارسة الرقابة الذاتية على قراراتها الادارية للتحقق من مشروعيتها وتصحيح القرار المعيب أو إلغاؤه، أو ممارسة الرقابة الادارية بناءً على تظلم الموظف، كما يمكن للقضاء ممارسة الرقابة القضائية على القرارات الادارية بناءً على دعوى إلغاء القرار الإداري وفحص مشروعية القرار والحكم إما بصحته أو ببطلانه وإلغائه.</p>

<p style="direction: rtl; text-align: left;">This study dealt with the impact of employment conditions in determining the legal status of the public employee in the United Arab Emirates at the federal and local levels of the Emirate of Ajman, and the statement of what the employment conditions are, in addition to determining the types of employment conditions regulated by the Federal Human Resources Law in the UAE and the Human Resources Law in the Emirate of Ajman, as well as analyzing the legal system of the various employment conditions stipulated by the UAE legislator, with a statement of the legal impact of employment conditions in determining the legal status of the public employee. Whether negatively or positively by comparing the position of the UAE legislator in Federal Decree - Law No. ( 49 ) of 2022 regarding human resources in the federal government and its executive regulations, and Emiri Decree No. ( 4 ) of 2017 regarding human resources in the Government of Ajman and its executive regulations and their amendments, and the controls related to employment conditions and a statement of administrative and judicial control procedures on administrative decisions related to employment conditions and the extent to which they protect the rights of public employees. This study is considered one of the important studies for employees in the country and in the Emirate of Ajman, as it is considered a scientific base that can be relied upon as an input to amend human resources systems. This study relied on the descriptive and analytical approaches in addition to the comparative approach, while the descriptive approach is based on describing the subject in theory in terms of concepts, definitions and controls, and the analytical approach is based on the analysis of jurisprudential opinions, judicial rulings and legal texts in the Federal Human Resources Law and the Human Resources Law in the Emirate of Ajman in terms of the legal regulation of employment conditions and their impact on the legal status of the public employee, while the comparative approach is based on a comparison between the position of the UAE legislator at the federal level. And the local level of the Emirate of Ajman. The most prominent results of this study show that there is compatibility between the Human Resources Law in the Federal Government and the Human Resources Law in the Emirate of Ajman in terms of the legal nature of promotion, secondment, modification of job status and loan, but there are some fundamental differences between them with regard to the legal organization and controls related to transfer, secondment and modification of job status. Also, through the study of oversight of decisions related to job status, it became clear that the administration has the right to exercise self- control over its administrative decisions to verify their legitimacy and correct or cancel the defective decision, or exercise administrative control based on an employee's grievance. The judiciary can also exercise judicial control over administrative decisions based on a lawsuit to cancel the administrative decision and examine the legitimacy of the decision and rule either on its validity or invalidity and cancellation.</p>
