Abstract
<p style="direction: rtl; text-align: right;"><strong>الملخص</strong></p>
<p style="direction: rtl; text-align: right;">تتناول الدراسة الضمانات الإجرائية للمتهم أمام المحكمة الجنائية الدولية مقارنة مع محكمتي يوغسلافيا السابقة ورواندا، فيما يتعلق بتشكيل المحكمة واستقلالية القضاة وحيادهم والضمانات المتعلقة بإمكانية ردهم أو تنحيتهم في حال وجود شبهة تحيز. حيث يناقش البحث هيكل المحكمة وآليات تعيين القضاة وعزلهم، وكيفية ضمان استقلاليتهم ونزاهتهم. كما يتناول الإجراءات التي يجب اتباعها أثناء المحاكمة من حيث علانية الجلسات، وشفوية المرافعة، وضرورة تدوين كافة الإجراءات. ويبين البحث أهمية هذه الضمانات في تحقيق محاكمة عادلة وشفافة تحفظ حقوق المتهم. ويركز على حقوق المتهم الأساسية خلال المحاكمة، وخاصة حقه في الدفاع وعدم جواز محاكمته مرتين عن نفس الفعل. ولقد استخدمت الدراسة المنهج الوصفي التحليلي المقارن من خلال تحليل ووصف القواعد والأنظمة الدولية المعنية بضمانات المتهم حال المحاكمة، وإجراء المقارنة بين محاكمة يوغسلافيا السابقة ورواندا وما شمله النظام الأساسي للمحكمة الجنائية الدولية الدائمة من قواعد في شأن هذه الضمانات.</p>
<p style="direction: rtl; text-align: right;">وخلصت نتائج الدراسة إلى أن النظام الأساسي للمحكمة الجنائية الدولية قد وفر ضمانات إجرائية أكثر شمولية وتفصيلاً مقارنة بالمحكمتين السابقتين، مما يعزز مبادئ المحاكمة العادلة ويتوافق مع المعايير الدولية لحقوق الإنسان.</p>

<p style="text-align: left;">The study examines the procedural guarantees for defendants before the International Criminal Court (ICC) compared to the International Criminal Tribunals for the former Yugoslavia and Rwanda, specifically regarding court composition, judicial independence and impartiality, and guarantees related to judicial recusal or disqualification in cases of potential bias. The research discusses the court's structure, mechanisms for appointing and removing judges, and how to ensure their independence and integrity.</p>
<p style="text-align: left;">The study also addresses procedures that must be followed during trial, including public hearings, oral arguments, and the necessity of recording all proceedings. The research demonstrates the importance of these guarantees in achieving a fair and transparent trial that preserves the defendant's rights. It focuses on the fundamental rights of the accused during trial, particularly their right to defense and protection against double jeopardy.</p>
<p style="text-align: left;">The study employed a comparative analytical descriptive methodology by analyzing and describing international rules and regulations concerning defendant guarantees during trial, comparing the tribunals of former Yugoslavia and Rwanda with the rules established in the Rome Statute of the permanent International Criminal Court regarding these guarantees.</p>
<p style="text-align: left;">The study concludes that the Rome Statute of the International Criminal Court has provided more comprehensive and detailed procedural guarantees compared to the previous tribunals, which enhances the principles of fair trial and aligns with international human rights standards.</p>
