Abstract

<p style="direction: rtl; text-align: justify;">تناولت الدراسة القرائن ودورها في الإثبات الجنائي - دراسة مقارنة ، وتهدف الدراسة إلى الاطلاع على موضوع القرائن ودورها في الإثبات الجنائي من كافة الجوانب القانونية ، وتحديد مدى ارتباط موضوع الدراسة في حقوق المتهم وحرياته وحق الدولة في العقاب وإثبات الجريمة بكافة الوسائل ، وسد حاجة المكتبة القانونية في دولة الإمارات العربية المتحدة لدراسات خاصة بالإثبات الجنائي عبر القرائن وبيان ماهية القرائن وانواعها وخصائصها وتحديد أنواع القرائن وتحديد دور القرائن في تعزيز ادلة الإثبات الجنائي المباشرة ، والبحث في سلطة القاضي الجنائي في استنباط واستنتاج الأدلة عبر القرائن</p>
<p style="direction: rtl; text-align: justify;">إن مشكلة الدراسة ذات بعدين، الأول هو عدم النص بشكل مباشر وصريح في قانون الإجراءات الجزائية الاتحادي رقم (38) لسنة 2022 على تنظيم القرائن ودورها في الإثبات الجنائي، والبعد الثاني يتمثل في الخلط بين القرائن والأدلة في بعض الأحيان كما ان مسألة سلطة القاضي التقديرية في مجال القرائن في ظل وجود بعض الأدلة ما زال محط خلاف فقهي قانوني.</p>
<p style="direction: rtl; text-align: justify;">تتمثل أهمية الدراسة من الناحية العلمية في انها من أوائل الدراسات في دولة الإمارات العربية المتحدة التي تتناول مسألة في غاية الأهمية في الإثبات الجنائي هي القرائن حيث ان القرائن لم تنل نصيبها الكافي من البحث في مجال الإثبات الجنائي ، في ظل قانون الإجراءات الجزائية الاتحادي لدولة الإمارات العربية المتحدة رقم ( 38 ) لسنة 2022 ، الذي لم بشكل مباشر القرائن ودورها في الإثبات الجنائي ، كما ان الدراسة تتناول بالتحليل والمقارنة موقف المشرع الإماراتي من القرائن القانونية ومقارنتها مع موقف المشرع المصري ، كما ان الدراسة تعتبر من الدراسات الهامة لرجال القانون والقضاة والطلاب والمتهم والمجني عليه كونها تبين دور القرائن في الإثبات الجنائي وضوابط ارتكان القضاء الجنائي للقرائن في الإثبات.</p>
<p style="direction: rtl; text-align: justify;">تعتمد الدراسة على المنهج الوصفي التحليلي والمنهج المقارن، حيث ان المنهج الوصفي يسهم في وصف موضوع الدراسة من الناحية النظرية من حيث المفاهيم والواقع النظري والتطبيقي للقرائن وذروها في الإثبات الجنائي، وخاصة من حيث حجية القرائن بنوعيها القانوني والقضائي، وتحليل ما جاء به المرسوم بقانون اتحادي رقم (38) لسنة 2022 بشأن الإثبات الجنائي والأدلة والقرائن، ومقارنة موقف المشرع الإماراتي من القرائن مع موقف المشرع المصري والمشرع الفرنسي في بعض الحيثيات التي تحتاج هذا النوع من المقارنة.</p>

<p>The study dealt with the clues and their role in criminal evidence - a comparative study - and the study aims to see the subject of evidence and its role in criminal evidence from all legal aspects, and determine the extent to which the subject of the study is related to the rights and freedoms of the accused and the state's right to punishment and proof of crime by all means, and fill the need of the legal library in the United Arab Emirates for studies on criminal evidence through evidence, and to indicate the nature of evidence, its types and characteristics, determine the types of evidence, and determine the role of evidence in enhancing direct criminal evidence evidence, and research In the power of the criminal judge to deduce and infer evidence through evidence. The problem of the study has two dimensions, the first is the lack of direct and explicit provision in the Federal Code of Criminal Procedure No. (38) of 2022 on the organization of evidence and its role in criminal evidence, and the second dimension is the confusion between evidence and evidence at times, and the issue of the judge's discretion in the field of evidence in the presence of some evidence is still the subject of legal doctrinal dispute.</p>
<p>The importance of the study from a scientific point of view is that it is one of the first studies in the United Arab Emirates that deals with a very important issue in criminal evidence, which is the evidence, as the evidence did not receive its sufficient share of research in the field of criminal evidence, under the Federal Code of Criminal Procedure of the United Arab Emirates No. ( 38 ) of 2022, which did not directly the evidence and its role in criminal evidence, and the study also analyzes and compares the position of the UAE legislator on legal evidence And compared with the position of the Egyptian legislator, as the study is considered one of the important studies for jurists, judges, students, the accused and the victim as it shows the role of evidence in criminal evidence and controls based criminal justice for evidence in proof. The study relies on the descriptive analytical approach and the comparative approach, as the descriptive approach contributes to describing the subject of the study in theory in terms of concepts and the theoretical and applied reality of the evidence and its culmination in criminal evidence, especially in terms of the authenticity of the legal and judicial evidence, and analyzing what was stated in Federal Decree - Law No. ( 38 ) of 2022 regarding criminal evidence, evidence and presumptions, and comparing the position of the UAE legislator on the clues with the position of the Egyptian legislator and the French legislator in some of the circumstances that need this type of Comparison.</p>
