<p><strong>المستخلص</strong></p>
<p>إن مهنة الصيدلة تقوم على تحضير وتركيب الأدوية والمستحضرات العلاجية وبيعها في قوالب وأشكال صيدلانية جاهزة للاستعمال مع إرفاقها بالنصائح والإرشادات الضرورية للاستفادة من التأثيرات العلاجية لها لعلاج الامراض أو منعها أو التخفيف منها.</p>
<p>تعد مهنة الصيدلة من المهن القديمة والتي بدأت بالمداواة بالأعشاب الطبيعية ثم تطورت تباعاً الى ما وصلت عليه في يومنا هذا، وتهدف الدراسة الحالية الى تحديد طبيعة المسؤولية المدنية للصيدلي وبيان أساسها القانوني وشروط قيامها وتوضيح الآثار المترتبة على مسؤولية الصيدلي المدنية عن أفعاله الضارة ومساعديه والعاملين معه ومدى كفاية القواعد العامة للمسؤولية المدنية لتعويض الأضرار الناجمة عن النشاط المهني للصيدلي.</p>
<p>و لقد قمت بالاستعانة في هذا البحث على المنهج الوصفي للتعرف على ظاهرة الدراسة ووضعها في إطارها الصحيح وتفسير كافة الظروف المحيطة بها، والمنهج التحليلي لتحليل التشريعات الخاصة واستخلاص المبادئ، وخلصت الدراسة لعدد من النتائج من أهمها : إن الأخطاء الصادرة عن الصيدلي أثناء مزاولة مهنته تكون أخطاء مهنية وان مسؤولية الصيدلي تقوم نتيجة لهذا الخطأ وتبعا للرأي الفقهي فإن معيار الخطأ المهني هو المعيار الموضوعي، وعند حدوث الضرر يقوم الصيدلي بسؤال عن الضرر المحقق ان كان ماديا أو أدبيا وقع على عاتق المضرور ثبات الخطأ الذي أصابه وأن مسؤولية الصيدلي تقوم على تعويض المرضى عن الضرر الناتج عن أخطاء التصنيع وفق المعايير الفنية، وأوصت الدراسة بضرورة تشكيل محاكم خاصة بضحايا الأخطاء الطبية بشكل عام وأخطاء الصيادلة بشكل خاص، من خلال تنظيم حملات توعية وتثقيف في هذا المجال، وهذا يكون أيضا بمساعدة علماء الدين من خلال توضيح أن هذا جزء من الضمان الذي نص عليه الفقه الإسلامي وليس تعويض محرم، وأن الشريعة الإسلامية والدين الإسلامي يقران هذا التعويض بصورة أكيدة وصريحة</p>

<p><strong>Abstract</strong></p>
<p>The pharmacy profession is based on preparing and formulating medicines and therapeutic preparations and selling them in ready-to-use pharmaceutical molds and forms, along with the necessary advice and instructions to benefit from their therapeutic effects to treat, prevent, or mitigate diseases.</p>
<p>The pharmacy profession is one of the ancient professions that began with treatment with natural herbs and then developed successively to what it has reached today. The current study aims to determine the nature of the pharmacist’s civil liability, explain its legal basis and conditions for its establishment, and clarify the effects of the pharmacist’s civil liability for the harmful actions of his, his assistants, and his workers, and the extent to which the adequacy of the general rules of civil liability to compensate for damages resulting from the professional activity of the pharmacist.</p>
<p>The researcher used the descriptive method to identify the phenomenon of the study, put it in its correct context, and explain all the circumstances surrounding it, and the analytical method to analyze the special legislation and extract the principles. The study concluded with a number of results, the most important of which are: The errors made by the pharmacist while practicing his profession are professional errors, and the pharmacist’s responsibility is As a result of this error and according to the jurisprudential opinion, the standard for professional error is the objective standard, and when damage occurs, the pharmacist asks about the damage achieved, whether it was material or moral. It is the responsibility of the injured person to prove the error that befell him, and that the pharmacist’s responsibility is to compensate patients for the damage resulting from manufacturing errors in accordance with Technical standards, and the study recommended the necessity of forming special courts for victims of medical errors in general and pharmacists’ errors in particular, by organizing awareness and education campaigns in this field, and this will also be with the help of religious scholars by clarifying that this is part of the guarantee stipulated by Islamic jurisprudence and not compensation. It is forbidden, and that Islamic law and the Islamic religion stipulate this compensation in a definite, clear and decisive manner in which it does not exist, and the necessity of adopting a compulsory insurance system against liability for medical damages within the framework of private insurance companies to identify risks and medical error is difficult to prove.</p>
