<p style="text-align: right;">تناولت الدراسة رد الاعتبار على ضوء أحكام القانون الاتحادي رقم 5 لسنة 2022 بشأن رد الاعتبار - دراسة مقارنة، وتهدف الدراسة إلى التعريف بنظام إعادة الاعتبار وأهميته وتحديد أنواع إعادة الاعتبار في دولة الإمارات العربية المتحدة والمملكة الأردنية الهاشمية مع بيان شروط إعادة الاعتبار وفق القانون اتحادي رقم (5) لسنة 2022 والبحث في صلاحيات تعزيز نظام إعادة الاعتبار. المحكمة في إعادة الاعتبار وبيان الآثار القانونية لإعادة الاعتبار وتقديم توصيات تسهم في تعزيز نظام إعادة الاعتبار.</p>
<p style="text-align: right;">إن رد الاعتبار من أهم الإجراءات التي تمكن المحكوم من الاندماج بالمجتمع، وتمكينه من ممارسة حقوقه، ونظراً لأهمية رد الاعتبار فإن المشرع الإماراتي سن تشريع خاص به هو القانون الاتحادي رقم (5) لسنة 2022، بينما إعادة الاعتبار غير مقننة في التشريع الأردني حيث أن قانون العقوبات الأردني وقانون أصول المحاكمات الجزائية الاردني أيضاً لا يحتوي على مواد خاصة بإعادة الاعتبار. وعليه يمكن بلورة المشكلة في التساؤل التالي: ما مدى فعالية نظام رد الاعتبار في حماية حقوق المحكوم؟ تتمثل الأهمية العلمية للدراسة من حيث كونها الدراسة الأولى في دولة الإمارات العربية المتحدة التي تناولت رد الاعتبار من حيث التنظيم القانوني والإجراءات والآثار وفقاً للقانون الاتحادي رقم ( 5 ) لسنة 2022 ، ومقارنة موقف المشرع الإماراتي مع المشرع الأردني الذي لم يسن تشريع خاص بإعادة الاعتبار ، حيث يتم الرجوع لنصوص قانون أصول المحاكمات الجزائية الاردني ، كما أن الدراسة تثري المكتبة القانونية الإماراتية التي هي بحاجة لهذا النوع من الدراسات المقارنة ، كما أن الدراسة سوف تقدم العديد من النتائج والتوصيات التي تسهم في تعزيز نظام رد الاعتبار في الدولة ، كما أنها من الدراسات الهامة للمحكومين والمحامين وطلاب القانون ولكل مهتم بنظام رد الاعتبار ، كما أنها تصبح قاعدة أساسية تستند إليها الدراسات التالية في المستقبل. ومن أبرز النتائج أوضح المشرع الإماراتي أحكام وشروط رد الاعتبار القضائي. ومن كل ما سبق توصل الباحث إلى أن التأهيل في القانون الإماراتي هو: الطلبات المقدمة من المحكوم عليهم قد تكون قانونية أو قضائية، تهدف إلى إزالة آثار العقوبة وإعادة دمجهم في المجتمع. ومن أبرز التوصيات إضافة الجنح والمخالفات التي يجوز فيها رد الاعتبار إلى نص المادة (2) من قانون رد الاعتبار الاتحادي لأن إضافتها يجعل التمييز بينها وبين ما لا يجوز فيه رد الاعتبار واضحاً ...</p>

<p style="text-align: left;">The study dealt with rehabilitation in light of the provisions of Federal Law No. 5 of 2022- a comparative study, and the study aims to introduce the rehabilitation system and its importance, determine the types of rehabilitation in the United Arab Emirates and the Hashemite Kingdom of Jordan, with a statement of the conditions for rehabilitation in accordance with Federal Law No. ( 5 ) of 2022, research on the powers of the court in rehabilitation, statement of the legal effects of rehabilitation, and make recommendations that contribute to strengthening the rehabilitation system. Rehabilitation is one of the most important procedures that enable the convict to integrate into society and enable him to exercise his rights, and given the importance of rehabilitation, the UAE legislator has enacted its own legislation, Federal Law No. ( 5 ) of 2022, while rehabilitation is not codified in Jordanian legislation, as the Jordanian Penal Code and the Jordanian Code of Criminal Procedure also do not contain articles on rehabilitation. Therefore, the problem can be crystallized in the following question: How effective is the rehabilitation system in protecting the rights of the convict? The scientific importance of the study is in terms of being the first study in the United Arab Emirates that dealt with rehabilitation in terms of legal regulation, procedures and effects in accordance with Federal Law No. ( 5 ) of 2022, and comparing the position of the UAE legislator with the Jordanian legislator who did not enact legislation on rehabilitation, as the texts of the Jordanian Code of Criminal Procedure are referenced, and the study enriches the Emirati legal library that is in need of this type of comparative studies, and the study will provide many One of the results and recommendations that contribute to strengthening the rehabilitation system in the country, as it is one of the important studies for convicts, lawyers, law students and everyone interested in the rehabilitation system, and it also becomes a basic base on which the following studies are based in the future. Among the most prominent results, the UAE legislator clarified the terms and conditions of judicial rehabilitation. From all of the above, the researcher concluded that qualification in UAE law is: " The requests submitted by convicts may be legal or judicial, aimed at removing the effects of punishment and reintegrating them into society ". One of the most prominent recommendations is to add misdemeanors and violations in which rehabilitation may be permitted to the text of Article (2) of the Federal Rehabilitation Law, because its addition makes the distinction between them and what may not be rehabilitated clear</p>
